Georgia has a law for protecting victims of family violence. The parties do not have to be married to seek this relief. The court can issue a temporary order evicting the offending party from the residence, or provide suitable housing for the victim and children, as well as financial relief.

Legitimation


In Georgia, if you are a man with a child that is born to a woman with whom you have never been married to, then you have no rights to the child. You are however , required by law to pay child support, and financially support that child, even if you have not legitimized the child. In some situations, the father has signed a document that states he has legitimized the child, but this document does not give the father any custody or visitation rights.

You must file a document in superior court to obtain these rights . The sooner you do this do this the greater your chances are of prevailing in your action.

Step Parent Adoption


In Georgia, if you are a Step-Parent, the biological mother or father of the stepchild to whom you are married, can agree for you to adopt their child, and become a legal parent. The other biological and or legal parent, must either relinquish their rights to the child, or your spouse can seek to have their rights terminated by the court, if they have sufficient legal grounds to do so.



Driving Under The Influence (DUI)


A driving under the influence offense occurs when you drink alcohol, or take drugs, whether prescribed or illegal, and operate a motorized vehicle in violation of Georgia law. As a separate matter, which arises in almost every DUI case, is a potential and separate suspension of your driver’s license and privilege to drive . In most cases after your DUI arrest, you must file a petition with the department of drivers services, and request a hearing , in order to help protect your right to drive. There is a ten day time limit for responding to the drivers services, in order to prevent an immediate suspension of your driving privileges .
